This research analyzes the procedural dimension of the acción de protección (action for constitutional protection) within the Ecuadorian legal system, based on the jurisprudence of the Constitutional Court from 2016 to 2026. The study employs a qualitative, legal-interpretative, and documentary approach, examining rulings selected for their thematic relevance, legal significance, and direct connection to the procedural categories under analysis. The jurisprudential matrix comprises 15 decisions—identified within the manuscript—and examines, for each case, the relevant facts, the legal issue, the governing rule, the supporting paragraphs, and the procedural contribution. The findings reveal criteria concerning the admissibility of this legal remedy, legitimatio ad causam (standing), judicial reasoning, evidentiary activity, the allocation of the burden of proof, the right to appeal, the requirement for a reasonable timeframe, and comprehensive reparation. Furthermore, the decisions examined highlight the necessity of distinguishing the effective protection of constitutional rights from the resolution of disputes involving mere questions of legality, which fall under the purview of other judicial channels. It is concluded that the procedural dimension of the acción de protección requires reasoned judicial action, an examination of the specific circumstances of each case, and adherence to the guarantees of due process and effective judicial protection. The study’s contribution lies in systematizing jurisprudential criteria that clarify both the obligations of constitutional judges and the limits of this jurisdictional guarantee.
