This essay undertakes a comparison between human intelligence and artificial intelligence (AI) in the legal field, arguing that the first possesses cognitive, epistemological, emotional and affective abilities that are crucial for jurists and that the second could never learn. Taking Carrie Menkel-Meadow’s teachings as the polestar, the essay will identify those fundamental abilities, analyse the features and limits of AI that make this latter incapable of learning such abilities, and finally make some suggestions on how we should develop the abilities at issue to lay down the foundations of a possible “Human Intelligence Project”.
