The overturning of Roe v. Wade in the United States has intensified anti abortion legislation and deepened health-care inequities for transgender, nonbinary, and gender expansive (TGE) people, who face systemic discrimination and restricted access to care. This paper employs critical discourse analysis to examine three policy texts, the Life at Conception Act (Citation2023), the No Taxpayer Funding for Abortion and Abortion Insurance Full Disclosure Act of 2025, and Defending Women from Gender Ideology Extremism and Restoring Biological Truth to the Federal Government (Exec. Order No. 14,168, Citation2025), to analyze how anti-abortion and anti-transgender policies erase TGE individuals from reproductive and medical recognition within health care and legal systems. Drawing on Foucault’s concept of biopower, Mbembe’s theory of necropolitics, and Butler’s critique of normative gender frameworks, the analysis demonstrates how these policies function to discipline and abandon individuals, reinforce binary gender norms, and determine which lives are deemed care worthy.
