Globalization, as a fundamental principle of the current political processes at the world level, has a reflection on the processes of free movement of goods, services, people and capital, enabling migrant flows to have a greater trend of development. It is assumed that migration during the next decade will be one of the fundamental issues in the social orders of countries, as well as at the supranational level in international, economic and political relations. More than one hundred million migrants live outside their countries of origin, so the legislative framework to respect human rights for immigrants is inadequate or seriously deficient, especially in relation to migrants who entered places outside of legal border crossings. The paper analyzes the legislative and factual situation of the protection of the corpus of fundamental rights and freedoms of migrants, because there is a legal gap in the protection of the rights of migrants, especially illegal migrants, which they should enjoy according to the norms of international law on the one hand and the challenges encountered in countries of transit and final destination. The paper will apostrophize certain issues related to the protection of migrants and are correlated with the rights to work, stay in the country of final destination and the protection of this category of persons. The paper will also anticipate questions about the imbalance in relation to the globalization of the labor force, which has a correlative relationship with migration flows.
