The article examines constitutionalism and the rule of law in African transitions with a specific focus on Malawi. A survey was conducted among government officials, civil society organizations, and academic experts in Malawi to gather insights on constitutionalism and the rule of law. Survey results indicate that while there is significant progress in establishing a constitution, implementation challenges persist, particularly regarding judicial independence and compliance with international human rights standards. The findings highlight the need for strengthened institutional mechanisms and public awareness campaigns to improve adherence to constitutional principles and uphold the rule of law. Enhanced training programmes for judiciary members and civil servants are recommended to ensure better understanding and application of constitutional provisions. Increased transparency in government operations is also suggested.
