The political rights of individuals are among the most important rights contained in the constitutional document, and the constitutions of countries have repeatedly emphasized these rights, especially the rights related to political participation such as election, voting, and nomination. Since these rights were marginalized in past periods of the history of the Iraqi state, the Iraqi constitution in force includes these rights in The text of the constitutional document in order to surround it with the kind of protection necessary to prevent abuses that may be exposed to it by the ruling authority, especially since the Iraqi constitution emphasizes the principle of separation of powers, and as is the case in all positive laws, the legislator often relies on the basic principles in the constitution when legislating it. For any law, if this law violates the general constitutional principles recorded in the constitution, it is vulnerable to being challenged as unconstitutional. Given the modernity of the democratic experience in Iraq, laws related to political participation, such as the election law, may face some obstacles during implementation, which prompted us to discuss these obstacles within the framework of political participation.
