This article addresses how legislative changes enhance procedural rights and obligations of law experts in administrative proceedings, suggesting necessary reforms in Ukraine.
The main purpose of article is to cover legislative provisions that will contribute to legal regulation by law experts, as other participants in the court in administrative proceedings of Ukraine and exercise law experts’ subjective procedural rights and legal obligations in the consideration of administrative case. The methodology of article will be methods of logic that include methods of analysis and synthesis, methods of deduction and induction, methods of scientific modeling and other methods of scientific knowledge. The first section of article aimed at study of theoretical bases scientific material, which covered by issues of legal regulation in activity by law experts, the definition of legal principles and outline procedural guarantees by law experts, as participants’ judicial process in administrative proceedings of Ukraine. Theoretical and legal provisions that determine the procedure and ways of implementation by law experts on subjective procedural rights and legal obligations in the judicial review of the administrative case play the significant role. The second section of article is cover regulatory and law provisions, which will facilitate legal regulation of activities by law experts, as well as implementation by law experts on subjective procedural rights and legal obligations in the administrative proceedings of Ukraine. The author of scientific article proposes a number of changes that can implemented in the list of legislative acts of Ukraine. The legislative changes substantiate and will have positive impact on procedural status by law experts, their procedural activity, will expand powers of the data as participants’ judicial process in administrative proceedings of Ukraine. In conclusions of article, the author proposes to improve certain procedural issues of implementation by law experts, their subjective procedural rights and legal obligations, as participants’ judicial process in administrative proceedings of Ukraine. In addition, the legislative amendments propose to eliminate legal gaps in professional activity by law experts, during court in the administrative case.
