The study examines gaps in legislative regulation regarding child removal, highlighting implications for parental rights and obligations.
The thesis presents a theoretical and legal analysis of the procedure for the removal of a child without deprivation of parental rights, as a means of protecting the interests of the child and a measure of family and legal responsibility for parents. The removal of a child is a temporary measure and is aimed primarily at protecting the child from threats that arise for him in the family, for a period granted to the parents to correct and create a safe, calm and stable environment for the child. It is emphasized that the legislation on the removal of a child contains a number of gaps that need to be regulated, given the importance of social relations in this area. In particular, this concerns the period of removal of a child, the possibility of repeated application of the removal of a child without deprivation of parental rights and a clear definition of the consequences of such a procedure for the rights and obligations of the parents.
