Interdisciplinary analysis highlights the role of the Bar in shifting from authority to law, suggesting a transformative impact.
The thesis presents an interdisciplinary approach to the study of the established paradigm and the new paradigm in the legal system, hypothetically expressed as “the power of authority” and “the power of law”. With the help of the epistemological approach, applying it is characteristic principles, in particular, dialectic, historicism and practice, the author finds out that, according to the current state of the philosophy of law, the functions of law provide an understanding of a wide range of professional activities of the representatives of the Bar in the “force of law” paradigm, where the role of the Bar acquires other qualitative characteristics. According to the author, in the “paradox” coordinate system, it is the institution of the profession of law which is a key element of the legal system and which is designed to help society make the transition from one paradigm (“the power of authority”) to a new paradigm (“the power of law”) in an evolutionary way, rather than a revolutionary one.
