Qualitative content analysis reveals discordances in legal and religious definitions of transgender and intersex persons in Pakistan, highlighting significant implications.
The research paper aims to examine discordances between religious and legal concepts regarding the recognition of transgender and intersex persons in light of Article 227 of the Constitution of the Islamic Republic of Pakistan. Through conducting a qualitative content analysis of hadith, Quranic verses, the constitution of the Islamic Republic of Pakistan, and judicial verdicts regarding transgender persons and intersex, this research explored those discrepancies that tend to exist between religious and legal definitions of transgender and intersex persons and legislations regarding transgender persons contradict the article 227 of constitution of Islamic Republic of Pakistan. Furthermore, this study comprehensively describes the contemporary situation with recommendations for policymakers, the state, and society.
