Qualitative analysis reveals the challenges faced by minors and disabled beneficiaries in vehicle redemption, highlighting procedural insights at Amanah Raya Berhad.
In Malaysia, the estate administration, such as a car, has its own procedures that must be followed. Particularly when beneficiaries such as minors under the age of 18 and disabled person do not have the necessary legal capacity. Because it involves a redemption process from the custodian or recipient to the beneficiary, the inheritance process involving this vehicle does not receive much attention from the community. As a result, this paper will examine the procedure for handling vehicles at Amanah Raya Berhad (ARB), an authoritative body that manages movable asset under RM600 thousand ringgit. This study is qualitative by using research methods based on research into statutory provisions, journal articles, books, acts, and websites. In addition, a semi-structured interview was conducted with two ARB officers. This paper found that there are various situations involving the redemption process. ARB, as the administrator, is responsible for safeguarding the rights of the beneficiary who does not have this legal capacity and ensuring that the benefits of the vehicle are guaranteed.
