This research explores land use change and plantation crimes in Indonesia, suggesting reforms to enhance environmental protection.
The Indonesian plantation is a sector that has an important role in the Indonesian economy which has several problems. This research tries to show some of these problems both factually and juridically. By using a non-doctrinal approach, this research discusses the problems of the plantation sector in Indonesia. The main problem of this research is the problem of land use change in plantations and the weak threat of the plantation crimes. The change of the land use without clear boundaries in the Plantation Law can cause environmental damage and harm various parties. In addition, the plantation criminal offenses are still problematic and debated between the needs/conditions, threats and potential impacts caused. The plantation criminal provisions are relatively lower than the criminal provisions in the environmental sector and the forestry sector, while the impacts caused are almost the same as the environmental sector and the forestry sector. This research explains the need for the role and collaboration of the Government, Plantation Business Actors, the Community and the other Stakeholders to overcome the problems of the plantation sector. In addition, this research can be a reference for the Government decision-making in considering changes and strengthening the plantation law in Indonesia in order to maintain a sustainable environment.
