In this article, on the example of theoretical developments and specific practical cases that took place in Russia in the 21st century, the criminal legal aspects of illegal hospitalization in a medical organization that provides psychiatric care in hospital conditions are considered. All elements of the composition of this criminal act are considered. The author emphasizes that in the case of prolonged use of psychotropic drugs, his nervous sys-tem is inhibited by a healthy person, as a result of which the personal opportunity to protect his rights is signifi-cantly reduced. This leads to the need to ensure its interests by the competent authorities and their officials. This study provides specific recommendations for improving law enforcement activities in the issue of prevent-ing illegal hospitalization in a psychiatric hospital of a mentally healthy person.
