Matters related to medical care are directly related to human dignity, the right to life, the right to enjoy health, the nation's obligation to health, and the right to self-determination. It has been reviewed only from political, policy, legislative, and economic perspectives. But from a constitutional perspective, there is a need to fully review the implications of enacting the Nursing Act. The nursing law enactment is also connected to the expansion of the integrated nursing and care service system and reform of the nursing system, which are urgently needed in preparation for the recent aging society. And the nursing law enactment is also connected to the maintenance of the already existing professional nurse system. A systematic review of nursing-related laws and regulations, including the actual situation of PA nurses who are already working in practice but have weak positive legal basis, is needed. In this study, the constitutional values for medical welfare revealed in precedents and theories were confirmed and applied to review the main issues of the nursing law enactment. This paper seeks to review the main issues of the nursing bill based on consideration of community welfare and medical welfare. The professional freedom, property rights, and freedom of business of medical professionals such as doctors, nurses, nursing assistants, and physical therapists have been overvalued. The constitutional basis is important in interpreting laws in the medical field, such as the people's right to enjoy health, the nation's obligation to health, the public good nature of medical services, and the non-profit nature of medical corporations. Keeping the constitutional basis in mind, we attempted to seek a more progressive direction on major issues in nursing law from the perspective of national medical welfare and regional welfare. Recently, the Administrative Procedure Act has stipulated provisions for activating public policy participation, and the public's opinions must be actively listened to and reflected in the policy-making process in the medical field. In the era of the 4th Revolution, there are still parts of medical services that must be performed by human hands. Nurses can excellently fill the vacancy of doctors in the underprivileged classes of the welfare state, mountainous areas, and industrial front lines. The establishment of nursing law legislation that reflects work improvement and treatment improvement can contribute to resolving regional gaps by strengthening regional welfare and can further have the effect of improving medical welfare nationwide.
