Analysis reveals the need to adapt intellectual property frameworks in the digital economy, highlighting AI's role in innovation.
Goal. The article examines the problem of the formation of a new paradigm of intellectual property in the digital economy based on the development of artificial intelligence and artificial neural networks. The impact of artificial intelligence and artificial neural networks on the intellectual property system is revealed and analyzed. Methodology. To achieve the goal, both general scientific and special methods of scientific knowledge were used, in particular scientific abstraction, induction and deduction, methods of logical and structural-functional analysis, and a systems approach. Results. It is determined that in the traditional paradigm of intellectual property, the key element of acquiring and recognizing rights is the participation of a person as a creator, however, in a situation where the results of creative activity can be generated by algorithms, the question of revising the principles of this approach arises. It is analyzed that artificial intelligence and artificial neural networks now act not only as objects of intellectual property as exclusive products of human creative intellectual activity, but also as tools for generating new objects of intellectual property in the form of new texts, images, works of art, scientific discoveries, technical solutions, etc. It is studied that artificial intelligence and artificial neural networks in the conditions of digitalization become not only catalysts for creating innovations, but also independent factors in the transformation of the intellectual property system. The need to revise the current paradigm of intellectual property is substantiated, taking into account the role of artificial intelligence and artificial neural networks. The conceptual principles of a new model of intellectual property adapted to the conditions of the digital economy are determined. Scientific novelty. The essence of the new paradigm of intellectual property, which takes into account the phenomenon of algorithmic creativity and the change in the economic essence of intellectual property as a key resource in the digital economy, is theoretically substantiated at an interdisciplinary level. Practical Significance. The results of the study can be used to form state policy in the field of intellectual property, develop a strategy for the transformation of intellectual property, improve the regulatory framework, as well as in the activities of higher education institutions, innovative companies and technology transfer centers.
