Legal analysis reveals high risks of subsidiary liability among heirs refusing an estate, highlighting the need to investigate undisclosed debts from an inherited business.
The work is devoted to the study of the problems of succession, which are complicated, among other things, by the closedness of information about the obligations of the testator during his lifetime to a large extent. But even after refusing inheritance there is a high risk of bringing the heir to subsidiary liability and violation of his property rights in court. The authors analyze court practice and give recommendations on how to minimize such risks in posthumous situations, paying great attention to the study of the testator's debts and inherited business.
