The study considers general theoretical problems of family legal personality of minors. The author comes to the conclusion that the general possibility of possessing family rights arises from the moment of birth, and individual elements it arises with the achievement of a certain age and coincidence with the corresponding element of legal capacity. The author considers that the embryo does not have the capacity to possess family rights.
