Consent of the victim is a controversial subject in the criminal law theory. Moreover, in our national doctrine it is an unexplored one. In the content of this article, we aimed to elucidate if it is necessary or it is not relevant to implent the consent of victim as a cause which removes the criminal character of the act. In order to accomplish this goal, we have used the method of comparative law and studied other countries’ judicial and legal practice related to the consent of victim. Consequently, we have identified which are the main conditions for valability of victim’s consent and how should be formulated the proposal for a law which will implement the consent of victim as a cause which removes the criminal character of the act in the Republic of Moldova’s Criminal Code.
