The article examines the specifics of the legal regulation of relations related to the division of hereditary property and common property of spouses, including a share in an agricultural production cooperative. The author notes the existence of legal uncertainty in the issue under consideration, which generates conflict situations between the cooperative and the acquirer of the hereditary and marital share in resolving the issue of membership in the cooperative. It is concluded that the spouse who inherited the share is an associate member of the cooperative, but does not have an unconditional right to be accepted into the cooperative as the owner of the marital share.
