The Development of the Procedural Status of a Suspect and the Introduction of the Institution of Investigative Judges: Interrelated Prospects of Improvement of Russian Criminal Proceedings

The relevance of the article is based on the pressing need for improvement of the Russian criminal procedure model for the purposes of simplification of the procedural order of criminal prosecution of an individual for a committed crime. The author suggests an opportunity to achieve the set goal by elimination of the institution of charging and shifting its main purpose aimed at assurance of the guarantee of admissibility of long-term personified criminal prosecution, including with the application of criminal procedure measures of prevention subject to the availability of sufficient grounds, to departmental control, prosecutor’s supervision by strengthening thereof and in most cases to an investigative judge that is suggested to be introduced in the Russian model of criminal proceedings as an independent institution.
