On the issue of the legal characteristics of the payment for unilateral refusal to fulfill an obligation

In the article the theoretical construction of payment for realization of the right to unilateral refusal from the contract is examined, the legal nature of this novelty is developed. There are given cases when it is acceptable to establish and charge a fee for unilateral refusal. The conclusions stated in the article indicate the possibilities of legislative improvement of the studied institute in order to unify law enforcement practice.
