Civil construction generates many benefits for society, but it also causes damage, such as the generation of a high volume of waste, known as Construction and Demolition Waste (CDW), which, if disposed of irregularly, has an impact on the environment and public health. In order to analyze the management of this waste in Mato Grosso do Sul and Paraná, this study analyzed the legislation of these states and data from companies in the area, obtained through online questionnaires. On this basis, divergences were found between the theoretical and practical outlooks of the construction industry, and the actions taken by these states to minimize the risks of CDW were compared. The results confirmed the difference between the theory and the actual scenario of the companies, as well as highlighting the discrepancy between the legislation, the actions of the state governments and the effective management of CDW between the states studied. It also highlighted the inability of both the companies and the federal and state governments to deal with the issue of solid waste in an effective and environmentally friendly way. Furthermore, it emphasized the importance of debating CDW and exploring ways of dealing with it more responsibly and quickly, as well as seeking satisfactory solutions and actions for non-generation, reduction, recycling and treatment, especially in the state of Mato Grosso do Sul.
