Abstract The time of marginalizing the crime of aggression is over. The establishment of a Special Tribunal for the Crime of Aggression against Ukraine is imminent. Furthermore, a proposal to align the jurisdictional scheme governing the crime of aggression in the Statute of the International Criminal Court with that applicable to the other crimes under international law received wide support at the July 2025 Special Session of the Assembly of States Parties among the States Parties. At the insistence of a minority, the final decision on this proposal was, however, deferred to 2029.
