Abstract: the article is devoted to the novella par. 1 p. 1 of Art. 86 of the Family Code of the Russian Federation in terms of the emergence of a new exceptional circumstance, which stipulates that each parent incurs additional costs for the maintenance of minor children and disabled adult children. This circumstance was recognized as the absence of a dwelling place suitable for permanent residence. The specified rule of law was introduced within the framework of the Concept of State Family Policy in the Russian Federation for the period up to 2025 in order to protect the housing rights of a minor child in the event of divorce between his parents. The article analyzes the draft Federal Law No. 809049-7 and an explanatory note to it, explaining the functional purpose of the introduced changes; the conclusions of the committees, received on the specified draft law, are considered; explores the main scientific approaches to understanding the category of "additional costs"; provides a critical review of those adopted within the framework of Art. 86 of the RF IC of law enforcement acts.
