A suite of model legal instruments a Florida county can adopt or place on the table before a large-scale data center application arrives, so that negotiation begins from a document the county wrote. The framework is deliberately bifurcated. A Design and Performance Standards Ordinance carries physical standards under the police power and contains no fee, charge, dedication, or monetary obligation of any kind. A voluntary Host Community Development Agreement under Chapter 163, Part II, Florida Statutes, carries all financial and proprietary terms, including a Civic Compute Allocation of one-half of one percent of installed capacity held by a community trust, and an indexed Infrastructure Mitigation Endowment. Following Sheetz v. County of El Dorado (2024), which eliminated the legislative safe harbor for monetary exactions, a consented bilateral instrument is preferable to an ordinance for monetary terms. Where the county owns the land, a Model Ground Lease substitutes a landlord's bargain for the exaction analysis entirely. Every figure is bracketed. No dollar amount is intended to travel from this model form to an adopting county; each must be derived locally from that county's own record. Status and limitations. No attorney-client relationship arises from this deposit or from any use of it. The framework has not been reviewed by licensed counsel and has not been adopted by any jurisdiction. Exhibit "B," on which every monetary provision depends, does not yet exist in quantified form; only its outline and methodology are included. Ten change records are absent from the archive: Host Community Development Agreement Amendments 1, 2A, and 3; Adversarial Review Memoranda 1 and 2; Drafting Rationale Addenda 1 through 4; and Ground Lease Amendment 1. Any jurisdiction considering adoption should obtain review by counsel admitted in that jurisdiction. The release notes (CHANGELOG_v2026.2.md), included, identify the current version of each instrument.. The companion record containing the methodology, modeling, and drafting record is licensed CC BY 4.0 and linked under Related works.
