The legal landscape of organ transplantation in India is primarily governed by the Transplantation of Human Organs and Tissues Act (THOTA). The aim of this review is to learn about the intricacies of the complex legal and ethical aspects of organ transplantation. We discuss the historical evolution, regulatory architecture, procedural mandates, and the ethical and legal challenges within the Indian and global contexts. We also describe the current statutory legal framework in India for organ donation and transplantation. By reviewing the established protocols for both living and deceased donors, the article details the framework of voluntary donation and the processes involved in maintaining national registries.
