Marriage is a physical and spiritual bond between a man and a woman aimed at establishing a happy and lasting family based on the belief in God Almighty. In Islamic law, a marriage guardian (wali nikah) is one of the essential pillars of marriage. Problems arise when a biological guardian (wali nasab) refuses to marry off a woman under his guardianship without a valid reason under Islamic law, known as wali adhal. This study aims to analyze the conformity of the appointment of a judicial guardian (wali hakim) in Decision Number 48/Pdt.P/2025/PA.Pwr with Islamic law and Indonesian positive law, as well as to analyze the reasons for the guardian’s refusal. This research employs normative legal research using statutory and case approaches. The legal materials consist of primary legal materials, including Law Number 16 of 2019, the Compilation of Islamic Law, Minister of Religious Affairs Regulation Number 20 of 2019, and the court decision, supported by books, journals, and relevant literature. The data were analyzed descriptively and qualitatively. The results show that the appointment of the judicial guardian is consistent with Islamic law and Indonesian positive law. The guardian’s refusal based on differences in religious organizations between LDII and NU and the length of the prospective couple’s relationship is not legally justified. Therefore, the appointment of a judicial guardian provides legal protection, certainty, justice, and benefit for the prospective bride.
