The relevance of the topic is due to the need to expand doctrinal views on the legal nature of the principle of justice as a key principle of the functioning of the non-state pension system. The purpose of the article is to reveal the legal nature of the principle of justice as a key principle of the functioning of the non-state pension system. Achieving the outlined goal was made possible by using a complex of methods of scientific knowledge, in particular, the dialectical method, the formal-logical method, the comparative legal method. The current legislation of Ukraine and legislative acts of other countries regarding the perception and legal regulation of non-state pension provision and the principle of justice as a key principle of the functioning of non-state pension provision are analyzed. It is emphasized that only in a free and fair society, every law-abiding citizen has the right to demand reliable legal guarantees for himself. Ensuring the principles of the rule of law is inseparable from the effectiveness of legislative regulation of relations in the field of non-state pension provision, which in general should be based on compliance with the justice of the legal system and legal acts. For the most part, pensioners are low-income clients of the non-banking financial services market who expect fair and respectful treatment. They most often do not trust professional participants in the financial services market, and having no alternatives, are forced to tolerate disrespectful treatment of themselves. As a result, pensioners as clients of the non-banking financial services market require special attention and protection. Based on the results of the study, in order to avoid any discrepancies in law enforcement approaches in the future, separate proposals have been made regarding the proper regulation of the issue of the principle of fairness in the field of non-state pension provision.
