This paper examines the thoughts of Hans Kelsen and Hans Nawiasky on the hierarchy of legal norms and their implementation within the Indonesian legal system. The study discusses Hans Kelsen's theory of Stufenbau des Rechts and the concept of Grundnorm, as well as Hans Nawiasky's development of the hierarchy of legal norms through the theory of Theorie von Stufenbau der Rechtsordnung, which classifies state legal norms into four categories: Staatsfundamentalnorm, Staatsgrundgesetz, Formell Gesetz, and Verordnung und Autonome Satzung. This research employs a normative legal research method using conceptual and statutory approaches. It analyzes the similarities and differences between the two scholars' theories and examines their relevance to the Indonesian legal system, particularly regarding Pancasila as the source of all sources of state law, the hierarchy of laws and regulations, the principle of lex superior derogat legi inferiori, and judicial review mechanisms. The findings demonstrate that both theories provide an important conceptual foundation for understanding the structure, validity, and consistency of legal norms. Their relevance remains significant in supporting the development of a coherent Indonesian legal system based on Pancasila and the 1945 Constitution of the Republic of Indonesia.
