Kata Kunci: Peradilan Pidana; Diferensiasi Fungsional; Dominus Litis Jaksa Abstract The paradigm shift in Indonesian criminal procedure law, from the colonial-era Herziene Inlandsch Reglement (HIR) to the Code of Criminal Procedure (Kitab Undang-Undang Hukum Acara Pidana/KUHAP) enacted through Law Number 8 of 1981, brought fundamental changes to the division of authority among law enforcement institutions. While the HIR was in force, the prosecution service held a highly dominant position because it had authority over both investigation and prosecution. Since the KUHAP came into force, however, this authority has been clearly divided: the police were given exclusive authority to investigate general crimes, while the prosecution service’s authority was limited to the prosecution stage. This raises the principle of dominus litis, a Latin term meaning “master of the case,” or the party that controls the course of a case. This principle places the public prosecutor as the party with ultimate control over the direction and continuation of a criminal case, particularly from the pre-prosecution stage through the enforcement of court judgments (execution). As dominus litis, the prosecutor should ideally not merely be a passive recipient of investigation results. Instead, the prosecutor should supervise, guide, and, within certain limits, control the evidentiary process from an early stage, so that cases submitted to court fully meet formal and material requirements and can be legally justified. This research examines the Position and Normative Relationship between the Principle of Functional Differentiation and the Prosecutor’s Dominus Litis Principle in the Indonesian Criminal Justice System under Prevailing Laws and Regulations, as well as the Ideal Future Concept for Regulating Prosecutorial Authority to Achieve Harmony between the Principle of Functional Differentiation and the Dominus Litis Principle within the Framework of Indonesian Criminal Justice System Reform. This is normative legal research, which examines law as written norms in force (das sollen), rather than as an empirical social phenomenon (das sein) that grows and develops within society. The findings show that the two principles have different normative positions. The principle of functional differentiation has been explicitly codified in Article 2 paragraph (2) of the 2025 KUHAP, shifting its status from a doctrinal principle to a binding general principle of criminal procedure law. In contrast, the dominus litis principle is not expressly formulated in either the Prosecution Service Law or the 2025 KUHAP. Nevertheless, the normative relationship between the two principles is complementary rather than antinomic. Functional differentiation operates as a structural principle that divides functions among institutions, while dominus litis operates as a controlling principle that determines whether a case proceeds. The two are brought together by the principle of coordination, which is equal, complementary, and mutually supportive, under Articles 58 to 63 of the 2025 KUHAP. Going forward, the ideal concept is integrated functional differentiation, with dominus litis limited to prosecutorial decisions. Harmonization can be achieved through three steps: expressly defining the limits of dominus litis in the KUHAP and the Prosecution Service Law, regulating coordination operationally through a Government Regulation, and attaching accountability to every exercise of prosecutorial authority through reasoned decisions, pretrial review, and transparent discretionary guidelines.
