Digital transformation has changed work organization and increased the relevance of psychosocial risks. This study analyzes the relationship between mental health, working time and the right to disconnect, examining their constitutional, labor and public health foundations. A bibliographic and documentary study was conducted using deductive reasoning, based on the Constitution, the Consolidation of Labor Laws, the National Policy on Workers’ Health and specialized literature. The results indicate that legal protection of health is not limited to physical accidents, also covering work organization, rest and psychological integrity. The study concludes that the right to disconnect may be understood as an instrument for protecting human dignity and preventing psychosocial risks at work.
