ABSTRACT: This research addresses the intersection between sexual rights and neurodiversity, focusing on gifted populations, analyzing the Brazilian and international legal, social and political context. It contextualizes the growing demand for recognition and protection of these rights in the face of neurodiverse complexities, highlighting the normative insufficiency and the need for specific public policies. The problem lies in the gap that exists for the effective guarantee of these rights, despite the legal and social advances observed. The general objective was to understand and systematize the legal, social and epistemological dimensions that influence this theme, promoting an interdisciplinary and innovative contribution. The research adopted the Giftedean neoperspectivist paradigm, incorporating theories of intersectionality, human rights and comparative law, applying the hypothetical-deductive method. The bibliographic and documentary narrative review was conducted with rigor, consulting databases such as Scielo, Scopus and Web of Science, using descriptors related to neurodiversity, human rights and public policies, resulting in the analysis of 78 high-impact scientific papers. The main findings point to advances in jurisprudence, the relevance of the intersectional approach and the need to expand public policies. The conclusions highlight the confirmation of the hypotheses about normative gaps and the importance of multidisciplinary action to overcome them. Limitations were identified regarding the availability of empirical data and the depth of specific studies. The theoretical, methodological and empirical contributions add value to the area of Law, Social Sciences and the formulation of inclusive policies, with an impact on postgraduate studies and society.
