The article assesses the issues of testamentary legal personality of citizens. Taking into account the analysis of the norms of civil legislation, the author suggests paying attention to the existing contradictions between the norms of the general part and the section on inheritance law of the Civil Code of the Russian Federation when determining the circle of persons who are granted active testamentary legal personality.
