Analysis of criminal behavior linked to provocation shows key prevention measures, indicating a need for updated legislation on liability.
The article analyzes social relations associated with the criminal behavior of individuals who deliberately provoke others to commit crimes, their psychological and criminological characteristics and prevention of such behavior. The purpose of the article is to study and formulate specific proposals for improving criminal legislation in terms of establishing criminal liability for the above acts, as well as to propose preventive measures based on the study of the personality of the provocateur. The study used dialectical, logical, and normative-legal methods. An analysis of the personal characteristics of provocateurs, including those related to the field of psychology, was conducted. Two types of provocateurs were identified: 1) individuals with a criminal record who are characterized by the loss of ethical guidelines; 2) officials who are willing to neglect the norms of law and morality for the sake of career advancement. Among the measures to prevent such acts, victimological prevention is proposed, aimed at working with potential victims of provocations. It is necessary to publicize information about such crimes and the mechanisms of their commission. Administrative supervision of persons who have already committed crimes can also have a positive effect on the future behavior of former convicts.
