Exploration of judicial decisions and legal customs in civil cases, indicating a need for legislative clarity.
The application of legal customs in the issuance of judicial acts has its own specifics, due to the legal nature of the custom, as well as the dynamism of its content. This issue becomes especially relevant in the context of achieving uniformity of judicial practice in civil cases. Within the framework of the conducted research, the content of the legal custom and the specifics of its application by courts in the consideration of specific disputes are considered. At the same time, the author concludes that it is necessary to amend the current legislation in terms of consolidating a single definition of legal custom for all branches of law where it can be applied, as well as establishing criteria for differentiating business practice from custom in general.
