The article considers the problem of sufficiency of guarantees for the protection of rights and legitimate interests of the consumer of financial services when considering his claim by the financial ombudsman. The prohibition on the involvement of a contractual representative by the consumer of financial services is criticized. In this vein, attention is drawn to both the deviation from the principle of equality, since legal entities participating in the consideration of the dispute can use the assistance of a representative, and to the limitation of the right to receive qualified legal assistance guaranteed by Art. 48 of the Constitution of the Russian Federation. The idea of the need to develop a system of procedural guarantees for the parties when considering a dispute by the financial ombudsman is outlined.
