Theoretical research investigates legal regime interactions during nuclear threats, suggesting improved regulations may enhance counter-terrorism efforts.
The aim of the work is to investigate the theoretical aspects of the interaction between legal regimes. Legal regimes in the legal system are considered by the author as micro-systemic legal formations. Using the interaction between the legal regime of anti-terrorist operations and the emergency situation regime as an example, the legal issues of their joint functioning are analyzed. Since the beginning of 2022, due to the increasing threats of nuclear terrorism amid the weakening of international legal mechanisms to prevent such acts, there is a need for additional legal regulation regarding the minimization of potential consequences of these acts. Since August 2024, for the first time in law enforcement practice, two legal regimes that are often classified in the scientific literature as extraordinary have been simultaneously introduced in the territory of individual entities of the state. The theoretical research is based on a systematic-structural method for studying legal phenomena and a comparative legal analysis of normative legal acts in the field of counter-terrorism, as well as a method of legal modeling taking into account law enforcement practice. The results of the work include the development of proposals for the Federal Law "On Countering Terrorism" regarding the clarification of the organizational foundations of such counteraction, as well as amendments to the Decree of the President of Russia dated July 11, 2004, No. 868, on the correction of the main functions of the Ministry of Emergency Situations of Russia. The author raises the issue of bringing the regulations of federal executive bodies involved in the implementation of legal regimes in the field of crisis management into compliance with the law. The study established that the correlation of legal norms involved in forming the legal foundation for the functioning of interacting legal regimes creates favorable conditions for achieving the goals set by the legislator. The author believes that coordinated functioning in unified spatial-temporal conditions will contribute to the improvement of the interrelation and interaction of legal norms in correlating legal regimes. The application of the research results will contribute to enhancing the effectiveness of legislative activity and coordination of the activities of government bodies in countering terrorism.
