This article reflects on the colonial origins of the State of Emergency and its repressive nature during crises in France.
In 1955 was voted a new exceptional regime, the State of Emergency, at the beginning of the Algerian war of independence. The regime allowed the administration to take repressive measures against the population in order to face crises. It became the main regime of emergency in France from its creation onward. By observing the links between the State of Emergency and other repressive regimes of exception, as well as the context of its creation, this article aims at reflecting on the colonial nature of the legal institution of the State of Emergency.
