Communication XIII-A — THE KOREAN HORSEₒ presents the developing DPRK >< Russia >< Ukraine configuration and brings it before assigned judicial capacity. The Communication begins from the publicly encountered movement of DPRK military personnel through recruitment, selection, training, transfer, deployment, battlefield presence and capture, while preserving the individual person and the person’s legal position within that military configuration. The accompanying annexes extend the empirical inquiry into warnings and threats, decision-making centres, forwarding of warning, constitutional and judicial capacities, representation and representability, access to judicial capacity, TRIAS POLITICA 3.0ₒ, EIGENMACHTₒ / COMPETENCE-ATTRIBUTED OWNPOWERₒ, SELF-ADDRESSABILITYₒ, VERWEERₒ, hybridity and reality testing, INTERFACEₒ, TRIAS VERITATIS 3.0ₒ, SOCIOREFLEXOLOGICAL GESTALTₒ, HYBRID NEGATIVITYₒ, and the performativity of adverse possibilities where the behavioural USER MANUALₒ remains partly or wholly unstated. The central judicial question is: CAN JUDICIAL CAPACITYₒ ENTER THE WAR CONFIGURATION IN TIME? Communication XIII-A brings the developing factual and institutional configuration before the International Criminal Court through CRIMENₒ, while preserving the Court’s own KRINEINₒ. It asks which legal positions, jurisdictional routes and timely judicial capacities become available from the Court’s assigned position while the INTERIMINTERVALₒ remains available. Communication XIII-A was submitted to the Office of the Prosecutor of the International Criminal Court on 7 October 2026 together with 22 files.
