Recognising Hybridity and Activating Independent Judicial Power

This research dossier brings together FHESS, FESS and FCLS working papers and a second institutional communication addressed to President Volodymyr Zelenskyy on 10 October 2026. The empirical point of departure is President Zelenskyy's public analysis of the relationship between American peace diplomacy and measures facilitating transactions involving Russian-origin diesel. This configuration is examined through the research concepts of HYBRIDITYₒ, GESTALTGRAMMARₒ, DIALOGICAL CIRCULARITYₒ, ENDOLOGICAL ENGAGEMENTₒ and CARE ACCOUNTABILITYₒ. The central scientific proposition is that the instrumental treatment of judicial institutions forms part of the hybrid political configuration. Selective engagement with, and avoidance of, independent judicial authority opens a strategic possibility for Ukraine: to activate precisely those judicial capacities from their own assigned competences and responsibilities. Priority is given to the International Criminal Court and the competent European judicial institutions, complemented by the International Court of Justice and American, Russian and Ukrainian judicial capacities. The dossier examines concrete institutional engagement points, protection of persons, preservation of evidence, judicial reciprocity, interim action and JUSTITIËLE SOLIDARITEITₒ (the responsible engagement of independent judicial capacities). The accompanying communication invites President Zelenskyy to consider a strategic movement from prolonged dependence on hybrid political dialogue towards independent judicial engagement. The research consciously privileges the generation of further inspiration, institutional readability and timely possibilities for responsible action over formal perfection or absolute coherence. Its propositions remain open to further empirical examination and scientific development.
