The organization and administration of special urban areas possess distinctive characteristics that differentiate them from those of other categories of urban areas. In particular, in light of the policy of promoting proactiveness, innovation, and responsible decision-making among local authorities in the administration of special urban areas, it is necessary to establish a dedicated legal framework governing the exclusion, exemption, and mitigation of legal liability applicable to public officials, civil servants, and other relevant actors. Such a framework is essential to safeguard the legitimate interests of those performing public duties while creating incentives for more effective governance and the sustainable development of special urban areas. This article identifies the shortcomings of the current legal framework governing the exclusion, exemption, and mitigation of legal liability for individuals exercising official powers, performing public duties, or implementing public policies in special urban areas. It further proposes several recommendations for improving this legal mechanism.
