The practice of bid-rigging in government procurement of goods and services constitutes a form of unfair business competition that violates Article 22 of Law No. 5 of 1999. Such practices not only hinder the creation of fair competition but also have the potential to cause losses to the state and reduce the efficiency of goods and services procurement. This study aims to analyze the legal considerations of the panel of judges in the Decision of the Medan Commercial Court No. 1/Pdt.Sus-KPPU/2021/PN Niaga Mdn and to review them from the perspective of Al-Munafasah At-Tijariyyah. This study is a normative legal study using a statutory approach. Data were obtained through a literature review of primary legal sources derived from the decision under study and secondary sources from journals and books related to the research topic, which were then analyzed qualitatively using content analysis. The results of the study indicate that the panel of judges upheld the KPPU’s decision because the elements of tender collusion were deemed to have been met based on the evidence examined by the KPPU, specifically the existence of vertical collusion between PT. Mina Fajar Abadi and the Procurement Working Group. This study also found that the decision was essentially in line with the principle of Al-Munafasah At-Tijariyyah, which emphasizes honesty, trustworthiness, transparency, and fair business competition.
