Special Provisions on Missing Persons: A Comparative Study between Islamic Sharia and Palestinian Law

Objectives: This study aims to analyze the Islamic legal framework and the Palestinian statutory regulations governing the status of missing persons, in light of the significant rise in the number of missing individuals in the Gaza Strip since 7 October 2023, and the resulting social and legal challenges related to family matters, property rights, and personal status. Methodology: The study adopts a comparative approach by examining Islamic legal texts and jurisprudential rulings, and comparing them with the relevant Palestinian legislation, with the objective of identifying areas of convergence and divergence in addressing the legal implications arising from the status of a missing person. Findings: The study concludes that Islamic law provides a detailed framework for dealing with missing persons, particularly concerning their spouses, property, and heirs. However, several aspects of Palestinian legislation still require further clarification, especially under the exceptional circumstances prevailing in the Gaza Strip. The findings also reveal legislative gaps related to the legally prescribed duration of disappearance and the establishment of presumptive death. Moreover, the study finds that the issue of missing persons constitutes a complex legal and social challenge that necessitates a precise and context‑sensitive regulatory approach. While harmonization between Islamic law and Palestinian legislation is possible, it requires legislative development that aligns with current realities. Recommendations: Based on the study’s findings, it recommends updating Palestinian legislation pertaining to missing persons, establishing clear mechanisms for determining disappearance and presumptive death, and providing procedural rules that facilitate families’ ability to pursue their legal rights. The study also recommends conducting further research on the social and economic impacts of disappearance during armed conflicts. Conclusions: The study concludes that the current Palestinian legal framework lacks clear and unified procedures for determining the status of missing persons, particularly in the context of armed conflict. A harmonized approach that aligns Islamic jurisprudence with statutory legislation is essential to ensure legal certainty for families regarding marriage, inheritance, and property rights. الهدف: تهدف هذه الدراسة إلى تحليل التنظيم الشرعي والقانوني لأحكام المفقودين في الشريعة الإسلامية والقانون الفلسطيني، في ظل الارتفاع الكبير في أعداد المفقودين في قطاع غزة منذ السابع من أكتوبر 2023، وما يترتب على ذلك من إشكاليات اجتماعية وقانونية تتعلق بالأسرة والمال والحقوق. المنهجية: اعتمدت الدراسة على المنهج المقارن من خلال دراسة النصوص الشرعية وأحكام الفقه الإسلامي، ومقارنتها بالتشريعات الفلسطينية ذات الصلة، بهدف تحديد أوجه الاتفاق والاختلاف في معالجة حالة الفقد وما يترتب عليها من آثار. النتائج: توصلت الدراسة إلى أن أحكام الشريعة الإسلامية وضعت إطارًا تفصيليًا للتعامل مع المفقود، خصوصًا فيما يتعلق بزوجته وأمواله وورثته، بينما لا تزال بعض الجوانب في القانون الفلسطيني بحاجة إلى مزيد من التحديد، خاصة في ظل الظروف الاستثنائية التي يعيشها قطاع غزة. كما أظهرت النتائج وجود فجوات تشريعية تتعلق بالمدة القانونية للفقد وإثبات الموت الحكمي، كما خلصت الدراسة إلى أن حالة المفقود تمثل إشكالية قانونية واجتماعية معقدة تتطلب معالجة دقيقة تراعي الظروف الإنسانية الراهنة. كما تبين أن التوافق بين الشريعة والقانون ممكن، لكنه يحتاج إلى تطوير تشريعي ينسجم مع الواقع الحالي. التوصيات: بناء على نتائج الدراسة، توصي الدراسة بضرورة تحديث التشريعات الفلسطينية المتعلقة بالمفقودين، ووضع آليات واضحة لإثبات الفقد والموت الحكمي، وتوفير قواعد إجرائية تسهّل على الأسر متابعة حقوقها. كما توصي بإجراء دراسات أعمق حول الآثار الاجتماعية والاقتصادية لظاهرة الفقد في الحروب. الاستنتاجات: خلصت الدراسة إلى أن الإطار القانوني الفلسطيني الحالي يفتقر إلى إجراءات واضحة وموحّدة في تحديد حالة المفقودين، خاصة في سياق النزاعات المسلحة. ويُعدّ توحيد الأحكام بين الفقه الإسلامي والتشريعات الفلسطينية ضرورة لضمان اليقين القانوني لأسر المفقودين فيما يتعلق بالزواج والميراث والحقوق المالية.
