Reflection of the Economic, Social and Political Dimensions on the Palestinian General Budget

Purpose: The aim of this study is to cover the extent of the impact of the Palestinian economic situation, especially in light of the Paris Economic Protocol, on the Palestinian general budget, show the extent to which the Palestinian general budget takes into account the social rights that Palestine has committed itself to preserving and promoting under the international treaties it has joined, and how this is reflected or not, in addition to knowing how the Palestinian political reality represented by the absence of the Legislative Council has affected the Palestinian general budget. Methodology: The researchers used the analytical inductive approach by extrapolating and clarifying the legal texts related to the general budget in the Basic Law and Palestinian legislation, and extrapolating and analyzing the economic, social and political reality. Findings: The study concluded that financial deficit in the Palestinian general budget arises due to the occupation’s withholding of clearance funds. As well as the failure of the Palestinian general budget to provide clear and detailed information about the allocations to support social human rights that Palestine is responsible for promoting and maintaining. Also, there is no parliamentary oversight of the Palestinian general budget due to the absence of the Legislative Council. Recommendations: The study recommends that relevant authorities strive to improve management, as occurred in 2004, when public revenues increased due to good management. It also emphasizes that the authorities responsible for preparing the general budget provide clear, detailed information on allocations for operating and development expenditures to implement the rights of children and women, the right to work and education, and gender equality in the Palestinian general budget. It also emphasizes the need to hold legislative elections to activate parliamentary oversight of the Palestinian general budget. الهدف: هدف هذه الدراسة إلى الإحاطة بمدى تأثير الوضع الاقتصادي الفلسطيني خاصة في ظل برتوكول باريس الاقتصادي على الموازنة العامة الفلسطينية، وبيان مدى مراعاة الموازنة العامة الفلسطينية للحقوق الاجتماعية التي وضعت فلسطين على عاتقها الالتزام بصونها وتعزيزها بموجب المعاهدات الدولية التي انضمت إليها، وكيفية انعكاس ذلك من عدمه عليها، بالإضافة إلى معرفة كيف أثر الواقع السياسي الفلسطيني المتمثل في غياب المجلس التشريعي على الموازنة العامة الفلسطينية. المنهج: استخدم الباحثون المنهج الاستقرائي التحليلي من خلال استقراء وتوضيح النصوص القانونية المتعلقة بالموازنة العامة في القانون الأساسي والتشريعات الفلسطينية، واستقراء الواقع الاقتصادي، والاجتماعي، والسياسي، وتحليله. النتائج: توصلت الدراسة إلى أن العجز المالي في الموازنة العامة الفلسطينية ينشأ بسبب احتجاز الاحتلال لأموال المقاصة. وكذلك عدم تقديم الموازنة العامة الفلسطينية لمعلومات واضحة وتفصيلية حول مخصصات دعم حقوق الإنسان الاجتماعية التي يقع على عاتق فلسطين تعزيزها وصيانتها. وأيضاً عدم وجود رقابة برلمانية على الموازنة العامة الفلسطينية بسبب غياب المجلس التشريعي. التوصيات: توصي الدراسة بضرورة سعي الجهات ذات العلاقة بتحسين الإدارة كما حدث في عام 2004، إذ زادت الإيرادات العامة بسبب حسن الإدارة. وكذلك التأكيد على الجهات القائمة على إعداد الموازنة العامة بوضع معلومات تفصيلية واضحة حول مخصصات النفقات التشغيلية والتطويرية لإعمال حقوق الطفل والمرأة، والحق في العمل والتعليم، وتعزيز النوع الاجتماعي في الموازنة العامة الفلسطينية، بالإضافة إلى ضرورة إجراء انتخابات تشريعية، وذلك لتفعيل الرقابة البرلمانية على الموازنة العامة الفلسطينية.
