Some of the consequences arising from the lawsuit (consideration – summoning the parties – responding to it) in Islamic jurisprudence compared to the UAE Civil Procedure Law (Comparative Study)

The research examines some of the effects resulting from lawsuits and compares them from both a jurisprudential and legal perspective. The aim of the research is to highlight the rulings resulting from considering the lawsuit, summoning the adversaries, and responding to them through Islamic jurisprudence and the UAE Civil Procedure Law. The research methodology is based on the comparative analytical inductive approach. This involves examining Islamic jurisprudential texts related to the effects of lawsuits, analyzing them scientifically to extract relevant rulings. This is then compared to what is stipulated in the UAE Civil Procedure Law. In conclusion, several key findings were reached, including that considering lawsuits from both a jurisprudential and legal perspective results in the acceptance of the lawsuit presented to the court and the judge positively hearing it. Additionally, if the defendant denies the claim without providing evidence against the plaintiff's allegations, both jurisprudentially and legally, a decisive judgment is issued in favor of the plaintiff
