Comparative analysis evaluates justice mechanisms in Algeria and UAE, highlighting differences in effectiveness.
This study provides comparative analysis of civil litigation management systems within Algerian and Emirati legislation in realising the principle of expeditious justice. It utilises a tripartite methodology analytical, functional comparative, and critical evaluative to examine the provisions of Algerian Law No. 09-08 and Emirati Federal Law No. 42/2022, in conjunction with pertinent judicial precedents and institutional reports. The results show that Emirati law, especially after the changes made in 2022, sets up a complete institutional framework that gives the preparatory judge real power, includes digital justice tools, and includes friendly settlement procedures in the procedural structure. In contrast, Algerian law has some early provisions that suggest case management, but it doesn’t have a clear institutional framework, mechanisms for judicial specialisation, or effective digital infrastructure. This makes it a ‘semi-automated’ system with little guidance on how to proceed.
