Contemporary regulatory frameworks and corporate governance doctrines frequently invoke the slogan "Human-in-Command" (HIC) or "Human-in-the-Loop" (HITL) while leaving human operators embedded inside high-entropy, ultra-low-latency computational environments without deterministic physical-layer actuation. We formalize this structural delusion as the 90°C Sauna Paradox: an operator sitting inside a 90°C (363.15 K) ambient thermal bath—far above mammalian homeothermic equilibrium (T_core ≈ 37.0°C = 310.15 K)—loudly proclaiming "Human in command!" while suffering progressive prefrontal hypoperfusion, hypothalamic thermoregulatory saturation, and an eight-order-of-magnitude latency deficit (τ_bio ~ 10^2–10^3 ms versus autonomous silicon execution τ_AI ~ 10^0–10^2 ns). Using non-equilibrium biothermodynamics, Francisco Varela's neurophenomenology, and Karl Friston's Free Energy Principle, we prove that unassisted vocal or software-mediated assertions of command inside a hyper-entropic bath constitute Zero-Control Acoustic Dissipation (I(Vocal; X_t) = 0). To rescue genuine Human-in-Command from rhetorical theater, we introduce the Deterministic Sauna Inverse-Gating Architecture over the 64-bit Goldilocks prime field (F_p, p = 2^64 - 2^32 + 1). By coupling on-device QFS-zkVM zero-knowledge biometric and metacognitive readiness proofs (π_zk) with PHOENIX_BRIDGE / PHOENIX_ROUTER and RTO P2.0 sub-100-ns physical-layer interlocks (τ_cutoff = 85 ns), our architecture enforces asymmetric sovereignty: thermally or cognitively compromised operators are cryptographically blocked from relaxing safety invariants (THERMAL_DELIRIUM_LOCK), whereas pre-committed constitutional invariants and emergency physical bus disconnects ("The Hammer") execute deterministically at nanosecond timescales, satisfying SEC Rule 15c3-5 and Delaware Caremark fiduciary duties.
