This article examines legal norms regulating mandatory education levels, suggesting improvements for clarity and enforcement.
The article examines the harmonization of constitutional and sectoral legal norms that define mandatory levels of general education and allocate duties for ensuring their attainment. It analyzes the legal consequences of normative discrepancies for law enforcement practice, including the risks of expansive interpretation of parents’ (legal representatives’) obligations and the resulting inconsistency of administrative decisions in the education sector. The study substantiates the importance of legal certainty, proportionality, and the unity of the legal space as guiding principles for resolving conflicts of norms and securing the predictability of regulation. It proposes directions for legislative improvement aimed at clarifying the scope of duties of participants in educational relations and strengthening guarantees for the realization of the right to education in the Russian Federation.
